Strict cognizance on the issue of burning of firecrackers during Diwali and other festivals/occasions

Port Blair, Nov 08: ORDER No. 1275 WHEREAS, the Supreme Court of India vide W.P.(Civil) No. 728 of 2015 dated 23/10/2018 has taken strict cognizance on the issue of burning of firecrackers during Diwali and other festivals/occasions etc.

AND WHEREAS, conditions exist in the air during festive seasons in which pollution level is very high and the bursting of fireworks also affect the ambient air and the lungs, eyes and ears of the people and is one of the causes of pollution in the environment.

AND WHEREAS, the bursting of firecrackers/fireworks has been identified as one of the sources of air pollution and noise pollution and it may aggravate the situation and is harmful for senior citizens and small children.

AND WHEREAS, the Supreme Court of India has directed that green crackers permitted by PESO (Petroleum & Explosives Safety Organization) are to be sold under valid permission and any manufacturer, sale, purchase/possession or use of crackers (carrying barium or other banned chemicals or mislabeled) is completely prohibited.

AND WHEREAS, Ankit Yadav, IAS District Magistrate South Andaman District have reasons to believe that circumstances exist where such use of firecrackers may seriously endanger life and property of the citizens and maintenance of peace and law & order in the jurisdiction of South Andaman District

NOW THEREFORE, in exercise of the powers conferred upon me by the Section 144 of the Criminal Procedure code, 1973 (No. 2 of 1947), I ANKIT YADAV, IAS, District Magistrate, South Andaman District, do hereby make this written order prohibiting use of firecrackers (carrying barium or other banned chemicals or mislabeled) except for green crackers permitted by PESO (Petroleum & Explosives Safety Organization) non religious occasions and not to use plastic carry bags while selling the fire crackers in the jurisdiction of South Andaman District.  As the notice cannot be served individually upon all concerned, the order is hereby passed ex-parte. This order shall be promulgated in the South Andaman District for information of the public by announcement through publicity vans and affixing of copies thereof at notice boards of the Office of the District Magistrate/
Sub-Divisional Magistrate/Executive Magistrates as well as prominent public places and publications in the newspaper having circulation in the district. Further, the Superintendent of Police/Sub-Divisional Magistrate/ Executive Magistrate and all authorities concerned shall ensure strict compliance of this order and shall adequately inform and sensitize the field functionaries to be vigilant in the matter.

Any disobedience of the above orders shall invite penal action in accordance with the prohibition order of the Supreme Court of India and U/s 188 of the Indian Penal Code,1860.
